Terms of Use

LearningPod was founded on the vision of providing a platform, a space, both for course developers to showcase their innovations and students who would like to self develop and improve their skills through online or instructor-led remote learning.

Please read and understand the Terms of Use before accessing or using Learning Pod. Our philosophy is to make it easy to do business with you and we have tried to make it as clear as possible.

1   Definitions

The “Agreement” refers, collectively, to all the terms, conditions, notices contained or referenced in this document (the “Terms of Service” or the “Terms”) and all other operating rules, policies and procedures that we may publish from time to time on the Website.

The “Service” refers to the applications, software, solutions, and services provided by Becobeko.

The “Website” refers to Becobeko’s website located at becobeko.com, and all content, services, and products provided by Becobeko at or through the Website. It also refers to Becobeko-owned subdomains of becobeko.com, such as learningpod.becobeko.com. Occasionally, websites owned by Becobeko may provide different or additional terms of service. If those additional terms conflict with this Agreement, the more specific terms apply to the relevant page or service.

“The User,” “You,” “Customer” and “Your” refer to the individual person, company, or organization that has visited or is using the Website or Service; that accesses or uses any part of the Account; or that directs the use of the Account in the performance of its functions. A User must be at least 13 years of age.

“Becobeko,” “LearningPod”, “We,” and “Us” refer to Becobeko, as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.

“Content” refers to content featured or displayed through the Website, including without limitation text, data, articles, images, photographs, graphics, software, applications, designs, features, and other materials that are available on the Website or otherwise available through the Service. “Content” also includes Services. “User-Generated Content” is Content, written or otherwise, created or uploaded by our Users. “Your Content” is Content that you create or own.

An “Account” represents your legal relationship with Becobeko. A “User Account” represents an individual User’s authorization to log in to and use the Service and serves as a User’s identity on Becobeko and subdomains.

2   Account Agreement

We provide two distinct type of user accounts namely Normal Users and Course Owners. Normal Users encompasses the role of a student, guest, non-editing teachers. Course Owners includes Teachers and Course Developers.

Normal Users. Subject to these Terms, you retain administrative control over your User Account and access to Content within courses under subscription or freely available.

Course Owners. Accounts that were created under these Terms has administrative control over your User Account and the Content within the courses you created. You are the owner of the courses and we consider you responsible for the actions that are performed on those courses.

You must provide a valid email address in order to complete the signup process. Any other information requested, such as your real name, is optional, unless you are accepting these terms on behalf of a legal entity (in which case we need more information about the legal entity). If you Account is based on subscription, additional information may be required for billing purposes.

We do not permit accounts registered by “bots” or other automated methods. We only allow human to create an Account.

You must be age 13 or older and to comply to your respective country of residence with regards to minimum age. Becobeko does not target our Service to children under 13. If we learn of any User under the age of 13, we reserve the rights to terminate that User’s Account immediately.

Your login may only be used by one person — i.e., a single login may not be shared by multiple people. You can login using different computers, laptops or mobile devices. But only one active session at any one time is permitted.

You are responsible for keeping your Account and password secure while you use our Service. Becobeko cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

For course owners, you are responsible for all content posted and activity that occurs under your Account (even when content is posted by others who have Accounts under your Account).

You will promptly notify Becobeko if you become aware of any unauthorized use of, or access to, our Service through your Account, including any unauthorized use of your password or Account.

3   Acceptable Use Policy

It is important that our services are only used in an appropriate manner and you agree that you will not violate under any circumstances. Our Acceptable Use Policy outlines those uses in greater details that are prohibited and how violations can be reported.

4   User-Generated Content

You may create or upload User-Generated Content while using the Service. You are solely responsible for the content of, and for any harm resulting from, any User-Generated Content that you post, upload, link to or otherwise make available via the Service, regardless of the form of that Content. We are not responsible for any public display or misuse of your User-Generated Content.

We do not pre-screen User-Generated Content, but we have the right (though not the obligation) to refuse or remove any User-Generated Content that, in our sole discretion, violates any Becobeko terms or policies.

5   Intellectual Property Notice

Becobeko and our licensors, vendors, agents, and/or our content providers retain ownership of all intellectual property rights of any kind related to the Website and Service. We reserve all rights that are not expressly granted to you under this Agreement or by law. The look and feel of the Website and Service is copyright © Becobeko. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML/CSS, Javascript, or visual design elements or concepts without express written permission from Becobeko.

6   Disclaimer of Warranties

Becobeko provides the Website and the Service “as is” and “as available,” without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the Website and the Service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement.

Becobeko does not warrant that the Service will meet your requirements; that the Service will be uninterrupted, timely, secure, or error-free; that the information provided through the Service is accurate, reliable or correct; that any defects or errors will be corrected; that the Service will be available at any particular time or location; or that the Service is free of viruses or other harmful components. You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content or other material obtained from the Service.

7   Limitation of Liabilities

You understand and agree that we will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential or exemplary damages, however arising, that result from:

  • the use, disclosure, or display of your User-Generated Content;
  • your use or inability to use the Service;
  • any modification, price change, suspension or discontinuance of the Service;
  • the Service generally or the software or systems that make the Service available;
  • unauthorized access to or alterations of your transmissions or data;
  • statements or conduct of any third party on the Service;
  • any other user interactions that you input or receive through your use of the Service; or
    any other matter relating to the Service.

Our liability is limited whether or not we have been informed of the possibility of such damages, and even if a remedy set forth in this Agreement is found to have failed of its essential purpose. We will have no liability for any failure or delay due to matters beyond our reasonable control.
